Terms of Service
Effective and last updated: October 15, 2026
These Terms of Service ("Terms") govern your access to and use of the BookSwap website, mobile applications, and related services (collectively, the "Service"). The Service is owned and operated by USPROJECT LLC ("BookSwap", "we", "our", or "us").
By creating an account, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old, or the age of legal majority where you live, to use the Service on your own. A minor may use the Service only with the involvement and permission of a parent or legal guardian. You may not use the Service if applicable law prohibits you from doing so.
2. Accounts
You must provide accurate information, keep your login credentials secure, and promptly update information that changes. You are responsible for activity under your account. Tell us immediately at info@swapbook.vip if you believe your account has been accessed without permission.
3. BookSwap's Role
BookSwap provides tools that help users discover books and communicate about swapping, gifting, or selling them. Unless we expressly say otherwise, BookSwap is not a buyer, seller, owner, carrier, or party to transactions between users. We do not possess, inspect, authenticate, price, deliver, or guarantee listed books or the conduct of any user.
4. Listings
When you publish a listing, you represent that you have the right to offer the book and that the listing is accurate and lawful.
- Use truthful titles, descriptions, photos, condition details, prices, and availability.
- Do not list stolen, counterfeit, pirated, illegally reproduced, recalled, or unlawful material.
- Do not use listings for spam, unrelated advertising, deceptive links, or services unrelated to books.
- Remove or mark a listing unavailable when the book is no longer available.
5. Transactions Between Users
Users decide whether and how to complete a swap, gift, or sale. The parties are responsible for agreeing on price, payment method, delivery or meeting arrangements, condition, taxes, refunds, and any other transaction terms. BookSwap does not guarantee payment or provide buyer or seller protection for direct transactions between users.
6. Meeting and Transaction Safety
Use reasonable care when interacting with another user. Meet in a well-lit public place, tell someone where you are going, inspect the book before completing a transaction, avoid carrying unnecessary cash, and stop communicating if anything feels unsafe. Never share passwords, verification codes, financial credentials, or sensitive identity documents. In an emergency, contact local authorities.
7. BookDrop
BookDrop lets users mark books left for others to find. Only leave a book where doing so is permitted by the property owner and local law. Do not create an obstruction, hazard, litter, or damage. Location information may be approximate, and we do not guarantee that a marked book remains at the location. Mark a BookDrop unavailable after it is taken or removed.
8. Paid Features and Subscriptions
Some features may require payment or a recurring subscription. The price, billing period, included features, and renewal terms are shown before purchase. Purchases made through Apple, Google Play, Stripe, or another payment provider are also governed by that provider's terms. Unless applicable law requires otherwise, refunds are handled under the policy of the provider that processed the purchase. Cancel before renewal through the same provider used to subscribe.
9. Your Content
You retain ownership of content you submit, including listing photos, descriptions, profile information, reviews, and messages. You grant BookSwap a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, format, and distribute that content only as reasonably necessary to operate, secure, improve, and promote the Service. You represent that you have the rights needed to submit the content.
10. Prohibited Conduct
You may not:
- Break the law or infringe another person's rights.
- Harass, threaten, discriminate against, impersonate, defraud, or exploit another person.
- Post false, misleading, abusive, sexually exploitative, or malicious content.
- Send spam, scrape data, use automated access without permission, or interfere with the Service.
- Introduce malware, probe security, evade access controls, or misuse reporting and support systems.
- Use BookSwap to facilitate unsafe, prohibited, or fraudulent transactions.
11. Suspension and Termination
You may stop using the Service or delete your account at any time. We may remove content, limit features, suspend, or terminate access when reasonably necessary to enforce these Terms, protect users or the Service, comply with law, investigate misuse, or address security risks. Where appropriate, we may provide notice or an opportunity to appeal.
12. Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available". We do not promise uninterrupted or error-free operation, that listings or users are accurate or trustworthy, that a book will remain available, or that a transaction will be completed. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
13. Limitation of Liability
To the maximum extent permitted by law, USPROJECT LLC and its officers, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits or data, or losses arising from user conduct, listings, meetings, or transactions. Our total liability for claims relating to the Service will not exceed the greater of USD 100 or the amount you paid to us for the Service during the 12 months before the event giving rise to the claim. These limits do not apply where prohibited by law.
14. Indemnification
To the extent permitted by law, you agree to defend and indemnify USPROJECT LLC from third-party claims, liabilities, damages, and reasonable costs arising from your content, your transactions, your violation of these Terms, or your violation of another person's rights. This obligation does not apply to the extent a claim results from our own misconduct.
15. Changes to the Service or These Terms
We may change the Service and update these Terms. If a change materially affects your rights, we will provide reasonable notice through the Service, by email, or on this page when required. The updated Terms apply from the stated effective date. Continuing to use the Service after that date means you accept the updated Terms.
16. Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Subject to any mandatory consumer rights in your place of residence, disputes may be brought in the state or federal courts located in New York. Nothing in these Terms limits rights or remedies that applicable law does not allow you to waive.
